If you are separating and looking for family lawyers in Southampton, we can take your case from the first phone call to the final order at Southampton Combined Court Centre. GOV.UK gives it Family Court location code 328. Children's social care inside the city boundary belongs to Southampton City Council, not Hampshire County Council. The Designated Family Judge for Hampshire sits at Portsmouth, so the court is here but the judicial leadership is not. Pre-booked face-to-face appointments can be arranged in Southampton or at our Oxford office.

Complex Children Specialist & Client Support

Your first conversation is with Hannah Overton, and her first question on a Southampton matter is which side of the city boundary your children live on — inside it the authority is Southampton City Council, and in Eastleigh, Totton or Romsey it is Hampshire County Council, whose Designated Family Judge sits at Portsmouth.

What a disputed school placement case from Southampton actually involves

Each parent with parental responsibility may name a different school in a child’s EHC plan. Neither can withdraw the other’s, so the court decides whose request stands. The route is section 8 of the Children Act 1989, a specific issue order. It is issued to the Family Court at Southampton Combined Court Centre.

The family-court issue was resolved by agreement without the court being asked to determine the school named in the EHC plan. The parents put their respective views and supporting material before the local authority within the relevant education timetable, with arrangements put in place for information to be shared and for future EHC-plan communications to be handled more consistently. The local authority then made its placement decision through the EHC-plan process.

Outcomes turn entirely on the facts of each case. Nothing here is a prediction or a promise about any other case.

Divorce lawyers in Southampton: the application is national, the money is local

A divorce no longer starts in a Southampton courtroom. Under the Divorce, Dissolution and Separation Act 2020 it is a no-fault application made online or by post for a £628 court fee, and neither spouse can block it. What stays local is everything that application leaves untouched: the house in Shirley or Sholing, the pension, the savings. If those are contested, the hearing is listed at Southampton Combined Court Centre, whose GOV.UK record includes Financial Remedy. The costly mistake is taking the final order first and leaving the money for later, because the final order ends the marriage but not the claims. Our divorce guide sets out the order to do things in.

Children and child arrangements: the Cafcass letter before any Southampton hearing

When parents cannot agree where a child lives or how time is shared, the application is a C100 to the Family Court at Southampton Combined Court Centre, and the court fee is £270. Before the first hearing Cafcass contacts both parents and sends the court a safeguarding letter; what you say in that call is read by the judge. The order that follows uses the words lives with and spends time with. The decision point is what you agree in the meantime: a pattern accepted under pressure in September becomes the status quo the court weighs in January. Read what a child arrangements order can and cannot fix before you agree anything.

The house, the pension and the savings: how family lawyers in Southampton split them

There is no formula. Section 25 of the Matrimonial Causes Act 1973 lists what the court weighs: each person’s needs, income and earning capacity, the length of the marriage, contributions, and first of all the welfare of any child under 18. The two largest assets are usually the home and a pension, and a deal that trades one for the other needs both valued properly. A verbal agreement, you keep the house in Bitterne and I keep my pension, is not an order, and either of you can still apply years later. For a Southampton couple the contested version is the Financial Remedy work the city’s court record lists. Start with how a financial settlement is worked out.

Domestic abuse: same-day protection for a Southampton home

If you are frightened of a partner or ex-partner, the application is a non-molestation order on form FL401. It can be made without notice, so the other person learns of it only when the order is served, and on an urgent application the court can deal with it the same day. Breaching the order is a criminal offence. An occupation order can settle who lives in the home in the meantime, whoever’s name is on the tenancy or the deeds. In Southampton the application is issued to the Family Court at Southampton Combined Court Centre. The wrong move is waiting for one more incident before asking. Our non-molestation order guide explains what the order does and what evidence helps.

Prenups, cohabitation and unmarried couples in Southampton

Southampton has two universities, and many couples here rent or buy a first home together without marrying. The law gives them no automatic share of each other’s property. If the flat in Portswood is in one name, the other partner has to prove a beneficial interest under the Trusts of Land and Appointment of Trustees Act 1996, which is slow and expensive; a cohabitation agreement written before the purchase costs a fraction of that. If you are marrying, a prenup carries real weight when both of you had advice, disclosed your assets and signed it well before the wedding. Read what a cohabitation agreement covers.

Why does a Southampton family case keep pointing at Portsmouth?

Because Hampshire’s judicial leadership sits there, not here. HHJ Melissa Barlow has been Designated Family Judge for Hampshire since 11 October 2024. Hampshire is on the Western Circuit rather than the South East. The two GOV.UK court records differ as well. Portsmouth Combined Court Centre carries Family Court location code 302 and lists adoption, forced marriage and female genital mutilation work. None of that appears on the Southampton record. Southampton carries 328 and lists Financial Remedy, which the Portsmouth record does not. Ask early whether your hearing will be listed at Southampton, at Portsmouth or remotely. A short question about a Hampshire listing can save you a wasted day off work.

Is your children’s case a Southampton City Council matter or a Hampshire one?

Inside the city boundary it is Southampton City Council. Two articles of the Hampshire (Cities of Portsmouth and Southampton) (Structural Change) Order 1995 settled that. Article 8 made Southampton cease to form part of Hampshire on 1 April 1997. Article 3 moved Hampshire County Council’s functions here to the city council on that same date. So children’s social care inside the boundary is the city’s own, while Eastleigh, Totton and Romsey remain Hampshire County Council. Does an assessment, a letter or a section 7 report name Hampshire when your children live inside the city? Straighten that out before anyone files anything. The same goes if the family has moved across the boundary and you are dealing with both authorities.

If you can divorce online, why would you need divorce specialists in Southampton?

Because the divorce and the money are two separate jobs, and a judge only hears argument on one of them. You apply to end the marriage through GOV.UK, online or by post, but a contested financial order goes to court. The Southampton record lists both Divorce hearings and Financial Remedy. The Portsmouth record lists divorce hearings but not Financial Remedy. That financial half — disclosure, a hearing, a judge who has read the papers — is where most people need specialist help.

What if one of you works rotations out of the port?

Then the alternate-weekend shape most orders default to will not fit a Southampton rotation. This is the UK’s main cruise port. On the Department for Transport’s 2025 sea passenger figures, 2.6 million of the UK’s 3.1 million international cruise passengers passed through Southampton. A child arrangements order can instead run in blocks that follow a rotation of that kind. Section 11(7) of the Children Act 1989 also lets the court attach directions and conditions to it. Write down the next few months of shifts before you speak to family lawyers in Southampton about a rota like this, because a block pattern is built from real dates, not a typical month.

Does a Southampton application go in on paper or through the digital route?

Both exist, and the GOV.UK record for Southampton Combined Court Centre names them. One is a court mailbox marked for the paper process, including C100 applications. The other is a separate digital route for public law case numbers beginning with C5. Settle which of those your case belongs to before you send anything.

Need family lawyers in Southampton when the city and Hampshire are both involved?

Start with the hearing date or school deadline in your hand. If nobody has told you whether it came from the city or from Hampshire, that is today’s call. A free first call sorts the Southampton half from the Hampshire half before anyone files anything. It covers which authority holds your children’s file and what to ask about where the next date will be listed.

If you came looking for divorce specialists in Southampton because money is in dispute, the same call checks whether yours is the Financial Remedy work the Southampton record lists. You do not have to come to Southampton Combined Court Centre to have that conversation. Call 0330 094 5880.
