Complex Children Specialist & Client Support

Reading Borough Council has run children's services in-house since 1 October 2025, so a Reading children matter now deals with the council directly rather than through an arm's-length company. Ask for Hannah Overton, and bring whichever name your letters arrived under — Reading Borough Council or Brighter Futures for Children — because it decides who she writes to first.

Can parents in Reading agree term time and holidays without a court order?

A search for divorce specialists in Reading is sometimes really a question about the children. Two parents divorcing separately could not agree how the children’s time should run across term and holidays. No application had been issued, so two questions stood: agree without a hearing, or record an order? The route is Children Act 1989 s.8 with the s.1(5) no-order principle. An application from Reading is issued at Reading County Court and Family Court on Friar Street.

What governs the choice between them is Children Act 1989 s.1(1) and s.1(5). Even on an agreed application the court applies the paramountcy principle and the no-order principle for itself, so the parties’ agreement is the starting point of the court’s enquiry rather than the end of it. The arrangements were recorded in a written parenting plan, with no court order sought or made.

Outcomes turn entirely on the facts of each case. Nothing here is a prediction or a promise about any other case.

Family law services in Reading

Kabir Family Law works in family law and nothing else, so whatever brings you to family law in Reading, the person you speak to handles only that kind of case. Each block below is written for this town: the court on Friar Street, Reading Borough Council, and the districts either side of the Thames.

Divorce and separation: what divorce lawyers in Reading sort out first

Under the Divorce, Dissolution and Separation Act 2020 a divorce needs no reason and cannot be defended on the facts of the marriage; the only grounds to dispute it are jurisdiction or the validity of the marriage. The application is made online, so Friar Street sees nothing of it unless money is contested. The first decision is whether to apply jointly or alone. The second, and the more expensive to get wrong, is whether to apply for the final order before the finances are settled, because rights that exist only while you are married, such as a claim on a spouse’s pension death benefits, end with it. How the divorce process works.

How family lawyers in Reading approach the arrangements for children

Reading is split by the Thames: Caversham and Emmer Green on the north bank, Tilehurst, Whitley and Coley to the south, so a “lives with and spends time with” plan has to survive the school run over Reading Bridge or Caversham Bridge. Children Act 1989 s.8 gives the court the power to fix that plan, but s.1(5) says it will not make an order unless one is better for the child than none, so the first job is a written parenting plan the other parent can actually keep. If an application does become necessary it needs a MIAM first, then a C100 with a £270 fee, and the court lists the first hearing, not you. What a child arrangements order covers.

How family lawyers in Reading handle the money side of a divorce

Nothing about money is settled by the divorce itself. Until a financial order is sealed either of you can bring a claim years later, which is why a settlement agreed at a kitchen table in Caversham is only safe once it has become a consent order. The court applies the Matrimonial Causes Act 1973 s.25 factors: needs, earning capacity, the length of the marriage, contributions, and the children first. Both of you disclose everything on Form E before anyone can say what is fair, and a settlement built on a guessed pension figure is very hard to reopen once sealed. Where the figures are contested, the hearing is listed at Reading County Court and Family Court. How a financial settlement is worked out.

Domestic abuse and urgent protection in Reading

A non-molestation order under the Family Law Act 1996 is applied for on form FL401 with no court fee, and where the risk is immediate it can be made without notice to the other person and served afterwards. Breaching it is a criminal offence, which is what gives the order its force. An occupation order can go further and decide who lives in the home. Friar Street’s counter is appointment-only even for urgent family applications, so the papers are prepared and the appointment booked before anyone travels into town. Where there are children, the abuse also shapes what contact is safe, and that is dealt with at the same time rather than left for later. How a non-molestation order works.

Prenups, cohabitation agreements and unmarried couples in Reading

There is no common-law marriage in England and Wales. A partner who moves into a house in Tilehurst that is in the other’s name has no automatic claim on it, and if the relationship ends the argument runs under the Trusts of Land and Appointment of Trustees Act 1996 on what was intended and paid, not on what is fair. A cohabitation agreement or a declaration of trust signed at purchase removes that argument for far less than the dispute it prevents. For couples marrying, a prenuptial agreement is not automatically binding, but one signed freely, with full disclosure and time before the wedding, has carried real weight since the Supreme Court’s Radmacher decision in 2010. What a cohabitation agreement covers.

Why does a Reading case go to Friar Street?

Because Reading County Court and Family Court, at 160-163 Friar Street, RG1 1HE, is the family court for the town, and the South East Circuit lists Reading among its Designated Family Judge areas. That court’s family office takes the paper process for the area, including C100 applications. Its public counter is open by prior appointment only, for urgent civil and family applications, so you cannot simply walk into Friar Street and hand papers in on the day.

Is Reading’s family work run from Oxford?

No. Our nearest office to Reading is in Oxford — but the court is not. Oxford does not appear on the judiciary’s published list of Designated Family Judge areas at all, while Reading does, so the judicial leadership for family work here sits on Friar Street and not in Oxfordshire. If someone has told you your matter will be “dealt with in Oxford”, they mean an office, not the court your papers go to.

Who runs children’s services in Reading now?

Reading Borough Council, directly. Children’s social care and education in Reading were delivered for seven years by Brighter Futures for Children, a company the council set up to run them. The council completed bringing those services back in-house on 1 October 2025. The Brighter Futures for Children name is still used externally, so a letter may arrive under either name and it is the same Reading service. If something has already arrived from Brighter Futures for Children or from Reading Borough Council, say so on your first call with us — it changes what has to be done first, and how quickly.

Where can I meet divorce specialists in Reading?

Pre-booked face-to-face appointments can be arranged in Reading, or at the Oxford office. Kabir Family Law keeps no premises in Reading — no counter to walk into, no local address to turn up at — so a Reading meeting is booked in advance, and the nearest office you can visit is the Oxford one.

Just separated? Should you get advice from family lawyers in Reading before writing to your ex?

Yes — phone before you put anything in writing to the other parent. A free initial consultation with one of our family law specialists is one call. You say what has happened, we tell you plainly what your options look like, and nobody steers you towards Friar Street if your matter does not need to go there. Most separating parents never need an order at all. Whether yours is one of them is not something a page can tell you. Call 0330 094 5880.

A short call with family lawyers in Reading before you file tells you which decisions are urgent and which are not. Not sure which court will deal with your case? You can check on the government’s Find a court or tribunal service.
